Old foodstuffs intended for particular nutritional uses

Regulation (EU No 609/2013) of the European Parliament and of the Council on food intended for infants and young children, food for special medical purposes and total diet replacement for weight control became applicable on 20 July 2016.

This Regulation repealed the Directive on foodstuffs intended for particular nutritional uses (2009/39/EC), and with the adoption of the new Regulation, the term "foodstuffs intended for particular nutritional uses" is no longer used in legislation.

Part of the foodstuffs previously classified as foodstuffs intended for particular nutritional uses fell under other legislation as of 20 July 2016. Such food categories include, for example:

  • sport nutrition products
  • gluten-free and very low gluten food
  • lactose-free and low lactose food
  • meal replacements for weight management
  • milk-based drinks for young children

These foods shall meet the requirements of the Food Information Regulation (EU No 1169/2011), the Claims Regulation (EC No. 1924/2006), and depending on the food, either the Fortification Regulation (EC No. 1925/2006) or the Food Supplement Regulation.
